Just a third of tax penalties upheld
HMRC came under fire recently for ‘rushing’ investigations into people accused of not paying the right tax or facing fines for late returns, as its own figures show two in three demands are overturned on appeal.
In the past financial year more than 10,000 taxpayers challenged demands from the taxman. Of these, some 5,881 had the claim overturned and another 670 had it partially overturned. That means just 3,475 demands were upheld. There has been a marked increase in the number of claims being overturned since the start of the pandemic.
John Hood, a tax partner with the accountancy firm Moore Kingston Smith, told The Times: “The coronavirus crisis has undoubtedly put immense pressure on HMRC and its people to administer. Investigators, in an effort to conclude ongoing inquiries and clear the decks, seem to have rushed into issuing decisions that have, in the light of day, turned out to be ill founded or not supported by the facts.”
